Let me make something clear: Staff Sergeant Barnes is innocent in the eyes of the law. Barnes’s actions can all be justified, as the law acknowledges the chaos and uncertainty of war. Technically the prosecution can still accuse him of malicious intent, recklessness and disregard for human life, but proving guilt beyond reasonable doubt would be a tall order. Evidence obviously would show that Barnes’s actions are more of a result of circumstance than intent. War itself is a crime, Barnes like many others, is merely a victim. Sorry, but The Uniform Code Of Military Justice (UCMJ) is not designed to punish soldiers for split second decisions made in the hear of battle. All of Sergeant Barnes’s actions are justified under the doctrine of military necessity.
